The work examines the amendments to the claim/mediation and to the judicial settlement procedures set out by Legislative Decree n. 156 of 2015, which provided for a whole revision of the rules set out by Legislative Decree n. 546 of 1992. Notwithstanding the legislative approach taken, the legislator did not “overturn” the nature of such procedures, but rather aligned them to the current needs of the applicable legislation. The provisions have thus been reformed in order to address “existing issues” in the light of the interpretation developed over the time by tax practice, literature and case law. The legislative amendments, going beyond the intentions of the same legislator, also lead to “new approaches” in the application of such procedures. All of the above allows to express a positive opinion on the legislative amendments recently enacted, however this does not prevent from stating that the legislator might have gone even further in order to ensure a greater coherence of the settlement procedures as a whole, a target which has only partially been reached.

Il contributo analizza le modifiche apportate agli istituti del reclamo/mediazione e della conciliazione giudiziale dal d.lgs. n. 156 del 2015 che ha proceduto ad una completa riscrittura delle connesse norme del d.lgs. n. 546 del 1992. Nonostante questa tecnica legislativa, il legislatore non ha “stravolto” la natura di questi strumenti, ma piuttosto ha cercato di adeguare il diritto scritto al diritto vivente. Le norme sono state così corrette per risolvere “vecchi problemi” alla luce dell’interpretazione che la prassi, la dottrina e la giurisprudenza avevano dato nel corso del tempo. La novella normativa, forse oltre le intenzioni dello stesso legislatore, apre anche “nuove prospettive” all’operatività di tali istituti. Tutto questo consente di dare un giudizio complessivamente positivo all’intervento da poco entrato in vigore, ma non esclude che, come si vedrà, il legislatore avrebbe potuto fare anche di più per garantire una maggiore coerenza del sistema degli istituti deflattivi del contenzioso, obiettivo che è stato solo parzialmente raggiunto.
