The US Supreme Court ruled that the provisions of the Patient Protection and Affordable Care Act (Ppaca), imposing on employers to include (among other benefits) abortion and contraception in health insurance for their employees, as well in case of conscientious objection of the entrepreneurs for religious reasons, are breaching the rules on religious freedom, especially the Religious Freedom Restoration Act (Rfra). The case is characterized by the obvious conflict between two freedoms, both important for the welfare of the citizens, and assisted by the same regulatory rank into the US legal system.

La Corte Suprema degli Stati Uniti ha stabilito che le previsioni del Patient Protection and Affordable Care Act (Ppaca), imponenti ai datori di lavoro di includere (insieme ad altre prestazioni) l’aborto e la contraccezione nell’assicurazione sanitaria dei propri dipendenti, pure in caso di obiezione di coscienza per motivi religiosi degli imprenditori, violano le norme sulla libertà religiosa, in particolare il Religious Freedom Restoration Act (Rfra). Il caso si caratterizza per l’evidente conflitto tra due libertà, di rilievo per il benessere dei consociati, ed assistite da pari rango normativo nell’ordinamento statunitense.
