During the social war of 90-88, one of the commanders of the Italics was C. Papius Mutilus, a member of an oldest and influent Samnite family. In the aftermath of the conflict with Rome we lose track of him. In Augustan age another Papius, almost namesake of his ancestor, becomes consul: he’s the author of a famous law for the regulation of marriages. Aim of the paper is to fill, at least partially, the gap in our information between the two Papii and to reconstruct, with the help of juridical and epigraphic sources, the destinies of Papii (freeborn or freedmen) in Italy between the late Republic and the Julio-Claudian age.
