Increasingly, contracts concluded by governments in OECD countries are subject to rules and standards set by a growing number of international organisations and treaties. This phenomenon, known as the "internationalisation" of the regulation of public administration contracts, is characterised by certain common principles, such as the promotion of competition between companies and the transparency of the procedures for selecting tenders and awarding contracts. The agreements and acts of international organisations, on the other hand, lay down different rules on access to tenders, qualification requirements and award criteria. The difference between the standards is sometimes determined by the concern for the specific interest of that organisation, sometimes by the exclusion of the subject from the objectives pursued by the organisation or the States that are signatories to the Agreement. Because of these differences, the lack of coordination between the disciplines may lead to conflicting rules. In some cases, however, the rules arising from different factors of internationalisation are congruent and mutually compatible or even equal. The work focuses on the investigation of the contrasts, convergences and divergences between the international rules of public contracts, also due to the absence of mechanisms for adjusting or settling the specific methods of dealing with the interests of supranational bodies.

Con sempre maggiore frequenza, i contratti conclusi dalle amministrazioni dei paesi Ocse sono soggetti a regole e standard stabiliti da un numero crescente di organizzazioni e trattati internazionali. Tale fenomeno, noto come “internazionalizzazione” della disciplina dei contratti delle pubbliche amministrazioni, si caratterizza per alcuni principi comuni, come la promozione della concorrenza fra le imprese e la trasparenza delle procedure di selezione delle offerte e di aggiudicazione dei contratti. Gli accordi e gli atti delle organizzazioni internazionali, d’altro canto, dispongono regole diverse in ordine all’accesso alle gare, ai requisiti di qualificazione, ai criteri di aggiudicazione. La differenza fra gli standard è, talora, determinata dalla cura dell’interesse specifico di quell’organizzazione, talaltra dall’esclusione della materia dagli obiettivi perseguiti dall’organizzazione o dagli Stati firmatari dell’Accordo. Per via di tali differenze, la mancanza di coordinamento fra le discipline può determinare contrasti di regole. In alcune ipotesi, tuttavia, le regole derivanti da distinti fattori di internazionalizzazione sono congruenti e fra loro compatibili o addirittura uguali. Il lavoro si incentra sull’indagine dei contrasti, delle convergenze e divergenze fra le regole internazionali dei contratti pubblici, anche dovuti all’assenza di meccanismi di adeguamento o di composizione dei metodi specifici di cura degli interessi degli enti sovranazionali.
